Following a complaint filed by NIKE Innovation of the Netherlands, INDECOPI, National Institute for the Defense of Competition and Protection of Intellectual Property, imposed a U$ 200,000 fine on Hermanos ANDIA S.A.C. for infringing NIKE Innovate's intellectual property rights by importing sneakers bearing a sign similar to one of the company's registered trademarks. An inspection of the Peruvian company's warehouse uncovered 4,300 pairs bearing the disputed mark. The legal dispute did not concern NIKE's classic Swoosh logo, but another symbol belonging to NIKE Innovation, consisting of a circle formed by several of the brand's original logos.
Following the national authority's ruling, the immediate seizure of the merchandise in question was ordered.
